By accessing or using our website (sustainergictech.in), requesting proposals, engaging our sustainability consulting services, or downloading technical collateral, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

If you do not agree with any part of these terms, you must refrain from using our portal and engineering consulting services. These terms apply to all visitors, clients, building owners, contractors, and corporate partners.

Sustainergic Tech provides specialized sustainability engineering and green building consultancy services across India, including but not limited to:

• Green Building Certification: LEED, IGBC, GRIHA, ECSBC, and WELL certification consulting and documentation.
• Building Simulation & Modeling: Energy modeling, daylight analysis, CFD simulations, and microclimate evaluations.
• Audits & Advisory: Energy audits, water audits, thermal comfort assessments, and carbon accounting.
• MEP & Commissioning: Commissioning authority services, HVAC design optimization, geothermal, and radiant cooling consultation.

Project deliverables, timelines, and milestones are defined in the corresponding formal technical proposals and service agreements agreed upon prior to project initiation.

All materials on this website and proprietary engineering tools developed by Sustainergic Tech—including text, graphics, branding, software models, report formats, design methodologies, logos, and calculation frameworks—are the exclusive intellectual property of Sustainergic Tech Pvt. Ltd. and are protected by Indian and international copyright and trademark laws.

• Client Deliverables: Clients receive ownership of final project reports and certification submissions upon full payment of contractual fees, while underlying calculation templates remain our proprietary IP.

Their display represents verified professional consulting, modeling, auditing, or commissioning services delivered by Sustainergic Tech and does not imply direct corporate sponsorship or endorsement.

To ensure precise engineering models, energy audits, and certification approvals, clients agree to:

• Provide accurate, complete, and timely project data (building drawings, HVAC schematics, electricity bills, operational schedules).
• Grant authorized access to site facilities for energy auditing and commissioning engineers.
• Ensure that submitted architectural plans do not infringe upon any third-party intellectual property or copyright.

Commercial terms and payment schedules are governed by the following provisions:

• Quotation Validity: Formal financial proposals remain valid for 30 calendar days from the date of issuance unless otherwise specified.
• Milestone Invoicing: Payments are due according to the agreed milestone billing schedule outlined in the contract or Work Order.
• Taxes & Statutory Dues: All fees are subject to applicable Goods and Services Tax (GST) as mandated by the Government of India.
• Certification Board Fees: Registration and review fees charged directly by rating bodies (USGBC, IGBC, GRIHA) are payable directly by the client unless explicitly bundled in our scope.

Engineering simulations, daylight studies, and energy models are technical estimations based on standard boundary conditions, weather data, and client-supplied operational inputs. Actual post-occupancy building performance may vary due to operational changes, weather fluctuations, or occupant behavior.

• Rating Body Approvals: Final green building certification levels (LEED Platinum/Gold, IGBC ratings) are determined independently by third-party rating boards. While Sustainergic Tech provides expert consulting, third-party approval timelines remain under the rating agency's authority.
• Cap on Liability: Sustainergic Tech's total cumulative liability for any claims arising out of consulting engagements shall not exceed the professional fees actually paid by the client for the specific service phase.

Both parties agree to maintain strict confidentiality regarding proprietary business information, architectural blueprints, financial estimates, energy consumption records, and technical documentation exchanged during the engagement.

Confidential information shall not be disclosed to any third party without prior written consent, except to authorized employees, sub-consultants under NDA, or when required by court orders or Indian statutory authorities.

These Terms & Conditions and any commercial contracts arising hereunder shall be governed by and construed in accordance with the laws of the Republic of India.

Any legal disputes, claims, or proceedings arising out of or in connection with our website or services shall be subject to the exclusive jurisdiction of the competent courts located in Jaipur, Rajasthan, India.
